Cases Involving A Fatal Construction Injury
Through hard work and tenacity, our firm was able to recover a large confidential settlement for the family of a Pearl Harbor worker who was fatally injured by an unsafe man-lift.
In an unexpected chain of events, our client entered a man-lift to perform some maintenance work and was lifted approximately 12 stories high. When the maintenance worker was unable to reach the target point of maintenance, the arms of the man-lift locked into an unsafe and unsteady angle, causing the basket to tip and fatally injure the maintenance worker.
Through extensive research, the use of experts and highly-skilled questioning, our team of attorneys discovered that there were similar incidences occurring nationally and internationally involving the exact same piece of equipment.
Our attorneys also discovered that the manufacturer of the man-lift used electronic safety limit switches to prevent the booms from being extended to an unstable position. However, the man-lift manufacturers failed to properly configure those safety switches into a fail-safe mode; meaning that if the switches themselves failed, the booms should have been automatically prevented from extending into an unsafe position.
The switch manufacturer had clear guidelines and instructions for the use of their switches and its use in certain positions. The man-lift manufacturers did not abide by these carefully set forth instructions.
